TERMS AND CONDITIONS FOR PHOTO BOOTH HIRE SERVICES BY FOREVER PHOTO BOOTHS ABN 32 912 725 427

These Terms and Conditions (“Agreement”) govern the provision of photo booth hire services (“Services”) by Forever Photo Booths ABN 32 912 725 427 (“Provider”) to the client (“Client”) in Australia. By booking and using our Services, the Client agrees to be bound by these Terms and Conditions. Please read them carefully.

1. Booking and Payment 
   1.1 The Client must make a booking request in writing, either by email or through our website, and provide all necessary event details, including date, time, and location.
   1.2 A deposit of 50% of the total hire fee is required upon booking to secure the Services. The remaining balance must be paid no later than 30 prior to the event.
   1.3 Payments can be made via Cash, Visa, Mastercard, Bank Transfer, as specified by the Provider.

2. Cancellation and Refunds
   2.1 Cancellation by the Client must be made in writing. If the cancellation is made:
   a) 60 days or more prior to the event, the deposit will be refunded in full.
   b) less than 60 days before the event, the deposit will not be refunded.
   2.2 In the event of cancellation by the Client less than 30 days before the event, the Client is liable to pay the full balance of the hire fee, unless otherwise agreed upon by both parties in writing.

3. Responsibilities and Liabilities 
   3.1 The Provider will make every effort to ensure the Services are provided as agreed. However, the Provider shall not be liable for any circumstances beyond its control that may prevent or delay the provision of the Services, including but not limited to equipment failure, power outages, or force majeure events.
   3.2 The Client is responsible for ensuring the event venue is suitable for the installation and operation of the photo booth. The Provider shall not be held liable for any damage caused to the venue or its fixtures during the provision of the Services.
   3.3 The Client acknowledges that the Provider may use photos taken at the event for promotional purposes, unless otherwise agreed upon in writing.

4. Use of Equipment and Props
   4.1 The Client agrees to use the photo booth and associated equipment in a responsible and appropriate manner, and not to misuse or damage any equipment or props.
   4.2 The Client shall be liable for any loss, damage, or theft of the Provider’s equipment caused by the Client, its guests, or event attendees, and shall be responsible for the full replacement or repair costs.

5. Indemnity
   5.1 The Client agrees to indemnify and hold the Provider harmless against any claims, liabilities, costs, or expenses arising out of or related to the Client’s use of the Services, including but not limited to personal injury, property damage, or infringement of any intellectual property rights.

6. Governing Law and Jurisdiction
   6.1 This Agreement shall be governed by and construed in accordance with the laws of Australia. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Australia.

7. Entire Agreement
   7.1 This Agreement constitutes the entire understanding between the Provider and the Client concerning the Services and supersedes any prior agreements or understandings, whether written or verbal.

By booking our Services, the Client acknowledges that they have read, understood, and agreed to abide by these Terms and Conditions.
